Special Judge Removes Allen’s Defense Attorneys From Double Murder Case

Special Judge Fran Gull officially removed defense attorneys Andrew Baldwin and Brad Rozzi from the Richard Allen double homicide case Tuesday morning in Carroll Circuit Court in Delphi.

Judge Gull told Allen, “I have great concerns with your representation.”

Judge Gull also asked Baldwin, “what has changed in past 12 days?”

Baldwin could not give Judge Gull an satisfactory answer to her question.

This goes back to a hearing in Fort Wayne on October 19 when Gull announced that both Baldwin and Rozzi had unexpectedly resigned form the case. Gull also accused both attorneys of “gross negligence.” Rozzi said that Allen still wants to be represented by him and Baldwin.

Rozzi had asked Gull to recuse herself from the case. Rozzi added Gull coerced him into making an oral promise to resign but he never filed the formal paperwork.

Attorneys Robert Scremin and William Lebrato were appointed to take over Allen’s case.

Court didn’t officially start until 9:42 a.m. Tuesday because both sides and the judge were discussing the attorney situation.

Allen’s trial date was set for October 15, 2024.
